The Ministry of Labour keeps, but does not publish, certain case data on Occupational Health and Safety Act prosecutions.  Dentons Canada obtained this data through a freedom of information request and analyzed it.  Chelsea Rasmussen, an associate at Dentons will present these results which hold some surprises that could affect your strategy when facing OHS charges.  Come and learn what the data says for your organization. What proportion of charged employers plead guilty?  Should you negotiate a plea deal with the Ministry or let the court set the fine?  What are the odds of winning at trial?  In what circumstances is the Ministry likely to withdraw charges?  When an accident results in charges, what are the odds of convictions and fines?
